The authority of the federal courts is obtained from the U.S. Congress. This is because there are lower federal courts which can be created by the Congress exclusively (Peak & Giacomazzi, 2019). The U.S. Supreme Court is also the final resort for all parties because the authority of the Supreme Court cannot be challenged by lower federal courts (Western, 2019). In case of state courts, their authority is obtained from state-specific laws as well as the constitutional laws (Peak & Giacomazzi, 2019).
